General Terms and Conditions for the Rental of Event Furniture, Audio, Video, Lighting, and Special Effects Equipment from Ekip Event, a brand of Ekip & Co Suisse Sàrl

1. Purpose of the Rental
These general terms and conditions govern the rental of event furniture and audiovisual equipment (hereinafter referred to as “the goods”) between Ekip & Co Suisse Sàrl, Zone Industrielle Le Trési 9B, 1028 Préverenges (IDE: CHE-337-198.837) (hereinafter referred to as “the Lessor”) and the client (hereinafter referred to as “the Lessee”).

2. Booking
The booking of the goods must be made in writing, by email, or via our website. A deposit of 20% to 50% of the total amount is required to confirm the booking.

3. Rental Period
The rental period is specified in the quote, which will serve as the rental agreement if accepted by the client. Any extension of the rental period must be agreed upon in writing with the Lessor and may incur additional charges.

4. Delivery, Installation, and Return
The Lessor undertakes to deliver and install the goods in good working order at the address agreed upon with the lessee. Delivery and installation fees will be specified in the quote. The Lessee must ensure that access to the venue is adequate for delivery. The lessee is required to return the goods to the address and on the date agreed upon with the lessor, in the same condition as upon delivery, with the exception of normal wear and tear.

5. Liability
The Lessor disclaims all liability for damages caused by the goods, except in the case of hidden defects or manufacturing faults. The Lessee is solely responsible for the use of the goods and any consequences that may arise therefrom.

6. Obligations of the Parties
Lessee’s Obligations
• The Lessee undertakes to use the goods in accordance with the instructions provided by the Lessor and not to use them for illegal purposes or purposes contrary to their intended use.
• The Lessee is responsible for any damage, loss, or theft of the goods occurring during the rental period. The lessee shall reimburse the cost of repair or replacement of the goods, in accordance with the provisions of the Swiss Code of Obligations.
• The Lessee shall insure the goods against all risks throughout the rental period.
• The Lessee undertakes to immediately inform the Lessor of any malfunction or damage occurring to the goods.
Lessor’s Obligations
• The Lessor undertakes to provide the Lessee with goods in perfect working order.
• The Lessor will assist the Lessee with the installation and dismantling of the Equipment if agreed upon (for goods where installation by the lessor is not mandatory).

7. Cancellation
In the event of a booking cancellation, the Lessee must inform the Lessor in writing. The cancellation conditions are as follows:
– Cancellation more than 60 days before the rental date: refund of the deposit less 200.- in administrative fees
– Cancellation between 60 and 20 days before the rental date: forfeiture of the deposit.
– Cancellation between 20 and 5 days before the rental date: payment of 50% of the rental amount
– Cancellation less than 5 days before the rental date: full payment of the rental amount.

8. Force Majeure
The parties are released from their obligations in the event of force majeure preventing the execution of the rental agreement.

9. Payment
The balance of the rental must be paid no later than 5 days before the delivery date. Payments can be made by credit card, bank transfer, or cash.

10. Termination
In the event of non-compliance by one of the parties with its obligations, the other party may terminate this contract as of right, subject to 30 days’ notice.

11. Disputes
In the event of a dispute, the parties undertake to attempt to resolve the disagreement amicably. Failing this, the dispute will be submitted to the competent courts of Lausanne, in accordance with Swiss law.

12. Amendments to the Conditions
The Lessor reserves the right to amend these general terms and conditions at any time. The amendments will be communicated to the Lessee and will come into effect upon their publication.
